An executive officer who knew an offence or civil penalty contravention would occur, was in a position to influence the organisation's conduct and failed to take all reasonable steps to prevent it is personally liable (up to one fifth of the organisation's maximum criminal penalty, one tenth of its civil penalty). In judging reasonable steps a court looks at what the officer did to make sure employees, agents and contractors knew and understood the requirements affecting them, and what the officer did on becoming aware of a contravention.
