Australia Indigenous Procurement Policy (May 2026)
Section 4 Mandatory Minimum Indigenous Participation Requirements for high value contracts – Australia Indigenous Procurement Policy (May 2026)

Australia Indigenous Procurement Policy (May 2026) 4.6.1: Approach to market: specify whether any component is delivered in a remote area and require tenderers to declare their compliance with past MMR contracts and to submit an Indigenous Participation Plan covering how the MMR will be met, current Indigenous employment and supplier use rates, their commitment to Indigenous participation and how significant outcomes will be delivered in any remote area; new panel deeds must state that the MMR applies to procurements from the panel

What does 4.6.1 require?

When inviting suppliers to a procurement to which the MMR applies, the entity must state whether any component is to be delivered in a remote area. The approach to market clauses must require tenderers to declare their level of compliance with any past contracts that included MMRs and to develop an Indigenous Participation Plan addressing how they intend to meet the mandatory minimum requirements, their current rate of Indigenous employment and Indigenous supplier use, their commitment to Indigenous participation, and whether any part of the contract will be delivered in a remote area and, if so, how significant Indigenous employment or supplier use outcomes will be delivered there. Procurements to establish new panels must include clauses in the approach to market and in the Deed of Standing Offer stating that the MMR will apply to procurements from that standing offer.
