Portfolios may negotiate with suppliers to apply MMR requirements to a varied contract where the variation brings the total value to 7.5 million dollars or more GST inclusive, more than half of the value is delivered in the specified industry sectors, and the variation presents an opportunity for increased Indigenous participation in delivering the remainder, with the requirements applying from the date of the variation. It is not appropriate where almost all of the contract has been completed, where the requirement would introduce inefficiency, or where changing the work package would burden entities and suppliers more than the Indigenous employment or supplier use outcome justifies. Introduction of targets to a varied contract is voluntary and must be mutually agreed; suppliers cannot be compelled and face no penalty for declining. Where agreed, reporting occurs through the IPPRS as a voluntary MMR so subcontracts count toward the Portfolio target.
