Section 4 Mandatory Minimum Indigenous Participation Requirements for high value contracts – Australia Indigenous Procurement Policy (May 2026)

Australia Indigenous Procurement Policy (May 2026) 4.2: MMR application: include Mandatory Minimum Indigenous Participation Requirements in the approach to market for every procurement wholly delivered in Australia valued at 7.5 million dollars or more (GST inclusive) where more than half the value falls in the Appendix B industry categories (eight from 1 July 2016, nineteen from 1 July 2020), including procurements from panels and coordinated or cooperative arrangements; excluded are CPR 2.6 contracts, the Appendix B sub-category exemptions and contracts delivered wholly or partly overseas, where voluntary application and IPPRS reporting are encouraged

What does 4.2 require?

Relevant Commonwealth entities must include the MMR in approach to market documentation for every procurement that is wholly delivered in Australia, valued at 7.5 million dollars or more GST inclusive, and where more than half of the contract value is spent in one or more of the specified UNSPSC industry categories: the eight in Appendix B Table 1 from 1 July 2016 (farming, building construction and maintenance, industrial cleaning, transport and storage, editorial and design, education and training, travel and lodging, politics and civic affairs) and the further eleven in Table 2 from 1 July 2020 (financial instruments, mining and oil and gas, industrial production, environmental, management and business services, engineering and research, financial and insurance, healthcare, personal and domestic, defence and public order, organisations and clubs), subject to the sub-category exemptions listed there such as property leases, insurance and retirement funds and military services. Procurements from standing offers and panels, including coordinated and cooperative arrangements, are covered. Contracts under paragraph 2.6 of the CPRs and contracts delivered overseas in whole or part are excluded, though entities may apply the MMR voluntarily to the Australian component or the whole and report it through the IPPRS so subcontracts count toward the Portfolio target. Model clauses are on the NIAA website and the Finance Clause Bank.
