Part 3: Hours of Work – Australia Electrical, Electronic and Communications Contracting Award 2020 (MA000025)

Australia Electrical, Electronic and Communications Contracting Award 2020 (MA000025) 13.8d: 13.8(d) Substitute rostered days off only for the permitted reasons, and pay if no substitute is granted

The employer may move a fixed or rotating RDO to another day and require work on the original day if it is needed so other employees can work productively, for out-of-hours maintenance, because of unforeseen delays to a project or part of it, or for other unforeseen or emergency reasons on a project. If no substitute day is given, the employee must be paid, on top of pay for the day off, for ordinary-hours work, 150% of the ordinary hourly rate; outside ordinary hours, 200%. An employee may, with the employer's agreement, swap their own RDO. Any substitute day falls in the same or the following work cycle. An RDO falling on an NES public holiday moves to the next working day unless the parties agree another day in that or the next cycle. Days here include part days where appropriate.
