An educational authority must not discriminate on the ground of disability in refusing or failing to accept an application for admission or in the terms of admission (s 22(1)), or against a student by denying or limiting access to any benefit, by expulsion or by other detriment (s 22(2)). An education provider, including a curriculum or course developer or accreditor, must not develop or accredit curricula or training courses whose content will exclude a person or subject them to detriment (s 22(2A)). Institutions established wholly or primarily for students with a particular disability may refuse students without it (s 22(3)). The Disability Standards for Education 2005 set out how education providers comply; acting in accordance with them is compliance (s 34).
