Australia Disability Discrimination Act 1992
Part 2 Division 2: Discrimination in other areas – Australia Disability Discrimination Act 1992

Australia Disability Discrimination Act 1992 s30: s 30 Requests for disability information only for a lawful purpose

Where it would be unlawful to discriminate in doing an act under Division 1 or 2, a person must not request or require information (by form or otherwise) in connection with that act if people without the disability would not be asked for it or the information relates to the disability, unless evidence shows, unrebutted, that none of the purposes was unlawful discrimination. Information may be sought, for example, to assess inherent requirements or to decide what reasonable adjustments to make, and evidence that an animal is an assistance animal may be requested (s 54A(5)).
