ACT Residential Tenancies Act 1997 s64AD-s57: ss 57 and 64AD No retaliatory termination

ACAT must disallow a lessor's termination notice if the tenant applies before the notice period ends and ACAT finds the lessor was motivated by the tenant applying to ACAT, complaining to a government entity, taking reasonable steps to enforce rights (for example seeking legal advice or mediation), obtaining an ACAT order, or publishing information about the premises, agreement or lessor that was not knowingly or recklessly false. Under s 57 ACAT must also refuse a lessor's application for a termination and possession order motivated by the same events.
