ACT Residential Tenancies Act 1997 cl93: Sch 1 cl 93 Other breaches: notice to remedy, then notice to vacate

For a breach other than rent, the lessor serves written notice requiring the tenant to remedy within 2 weeks if the breach can be remedied; if it is not remedied or cannot be, a notice to vacate of 2 weeks follows, and only if the tenant stays may the lessor apply to ACAT for termination. On a third breach on any ground the lessor may go straight to a notice to vacate. ACAT ends the tenancy only if the breach justifies it and may refuse where the breach is remedied, and for illegal use must also be satisfied that the illegal use justifies termination (s 48).
