ACT Residential Tenancies Act 1997 cl92: Sch 1 cl 92 Rent arrears: notice to remedy before notice to vacate

To end a tenancy for unpaid rent the lessor may, once rent is at least 1 week overdue, serve a notice to remedy stating that if all rent owing to the date of payment is paid within 7 days no further action follows; if not paid, serve a notice to vacate of 2 weeks, then apply to ACAT, with the hearing not before the notice period ends. Only after two earlier notices to remedy in the same tenancy may the lessor go straight to a notice to vacate. ACAT may instead make a payment order (s 49A).
