Victoria Occupational Health and Safety Regulations 2017 r238: r 238 Employer must remove asbestos, or else enclose, or else seal it

For asbestos under its management or control, an employer must, as far as reasonably practicable, eliminate the associated risk by removing the asbestos. If removal is not reasonably practicable, the employer must enclose it to lower the risk as far as reasonably practicable, and if a risk remains after enclosure, by sealing it as well. The employer must consult employees and any health and safety representative when deciding the measures (Part 4 of the Act, r 21). Act compliance: ss 21 and 23.
