An employer or self-employed individual must make sure that nobody is exposed, because of how the business is conducted, to an atmospheric asbestos fibre concentration above the asbestos exposure standard. To meet this they must eliminate airborne fibre exposure at the workplace that comes from their undertaking as far as reasonably practicable, and if elimination is not reasonably practicable, reduce that exposure as far as reasonably practicable. The employer must consult employees and any health and safety representative on the control measures (Part 4 of the Act, r 21). Act compliance: ss 21, 23 and 24 (r 7).
