Victoria Occupational Health and Safety Regulations 2017 r233: r 233 Employer must obtain the site register and identify asbestos under its own control

At a workplace covered by Division 5, an employer must get a copy of the asbestos register from any other person holding management or control of the workplace, and must, as far as reasonably practicable, find all asbestos it manages or controls, including asbestos-containing material fixed or installed in its plant. Where material is of uncertain status on reasonable grounds, or inaccessible areas probably contain asbestos, the employer must assume asbestos or have a sample analysed (assumed asbestos counts as identified). For identified asbestos it must establish location, likely source of unfixed asbestos, the type, friability, condition and damage likelihood of asbestos-containing material, and, so far as possible, activities likely to disturb it; inaccessible areas need location and source so far as possible. Presence and location of what it identifies must be clearly shown, by labels where reasonably practicable. Act compliance: ss 21, 23 and 26.
