Victoria Occupational Health and Safety Act 2004 s75-4: s 75(4) and (5) Continue paying employees during a justified stoppage

If, after attending under s 75, an inspector issues a prohibition notice or determines in writing that employees had reasonable cause for concern about their health or safety, an employee who did not work while the issue was pending, and who would otherwise have been paid, keeps the right to be paid for the time not worked. Disputes about the entitlement may go to the Magistrates' Court or another court or tribunal with jurisdiction.
