Victoria Occupational Health and Safety Act 2004 s44-2: s 44(2) Establish the agreed DWGs by written notice to employees

Once negotiations produce agreement on the s 44(1) particulars, the employer must formally set up the DWG or DWGs exactly as agreed by issuing written notice to its employees. Informal acceptance is not enough: the establishing act is the written notice. Maximum penalty: 10 penalty units for an individual, 50 for a body corporate. If agreement cannot be reached in a reasonable time, any party may ask the Authority for an inspector to decide the unresolved particulars (s 45).
