Victoria Occupational Health and Safety Act 2004 s73-1: s 73(1) Resolve health and safety issues by the agreed or prescribed procedure

When a health or safety issue comes up at a workplace or out of the employer's undertaking, the employer (or its representative) and the affected employees, or the HSR where the issue arises in a DWG, must try to settle it using the relevant agreed issue resolution procedure or, if none exists, the procedure prescribed by the regulations. If the issue stays unresolved after a reasonable time, any party may ask the Authority for an inspector, who must attend as soon as possible and enquire into the issue, using any powers reasonably needed (s 75(1) to (3)).
