Victoria Occupational Health and Safety Act 2004 s70: s 70 Allow persons assisting an HSR to access the workplace

An employer with employees in a DWG must let a person who is assisting the HSR enter the workplace. The only ground for refusing is that the employer considers the person unsuitable because they lack sufficient OHS knowledge. If access is refused, the HSR may seek a Magistrates' Court order that directs access and setting its terms and conditions.
