Part 7: Representation of employees – Victoria Occupational Health and Safety Act 2004

Victoria Occupational Health and Safety Act 2004 s67-1: s 67(1) to (3) Allow HSRs to attend initial and annual refresher OHS training

At the request of an HSR for a DWG that includes its employees, an employer must let the HSR attend: (a) an initial occupational health and safety course after being elected; and (b) once the initial course is done, a refresher every year while in office, at a minimum. The HSR must make the request at least 14 days before the course starts. The course must be approved or conducted by the Authority, relevant to the members' work or the HSR role, and chosen by the HSR in consultation with the employer. The same applies to deputy HSRs (s 57(3)). If one of several employers of a DWG complies, all are treated as complying (s 67(8)).
