Victoria Occupational Health and Safety Act 2004 s54: s 54 HSR elections by DWG members under the prescribed procedure

Each HSR is chosen by vote of the members of the DWG they will represent. Only a member of that DWG who is not disqualified under s 56 may stand, and every member may vote. Members decide how the election is run, subject to any procedure prescribed by the regulations; failing agreement in reasonable time, a member can request that the Authority arrange for an inspector to run it or appoint someone to do so. Where candidate numbers equal vacancies, no ballot is needed and each candidate is taken to be elected. Employers should not run or steer the election against the members' wishes.
