Part 9: Inspectors and enforcement – Victoria Occupational Health and Safety Act 2004

Victoria Occupational Health and Safety Act 2004 s100-2: s 100 Produce documents and answer an inspector's questions

Once lawfully inside a place, an inspector may demand that a person produce all or part of a document, may examine it, and may require a person there to answer questions. A person must comply unless they have a reasonable excuse. Maximum penalty: 60 penalty units for an individual, 300 for a body corporate. Before making the requirement the inspector must show an identity card, warn that failing to comply, absent a reasonable excuse, is an offence, and advise that a question may be refused if the answer would tend to self-incriminate; no prosecution lies if that was not done. Legal professional privilege is preserved (s 155). A prosecution must begin within 12 months of the Authority becoming aware of the offence.
