The contractor may claim an extension of time only for a delay that was not reasonably foreseeable and beyond its reasonable control, caused by the owner, or caused by a compliant variation, and only if the claim is made in writing within 10 business days of becoming aware (or when it ought reasonably to have become aware) of the cause and extent of the delay and the owner approves it in writing. It must not rely on an extension not claimed this way, and must give the owner a signed copy of an approved claim within 5 business days. Maximum penalty 20 penalty units for each.
