The owner may withdraw from a regulated contract within 5 business days after receiving the signed copy (for level 2, also within 5 business days after receiving the consumer building guide if it came later), or at any time after 5 business days if neither has been received, by signed written notice given, left at or served on the contractor's address. Withdrawal is not available where a substantially identical previous contract existed or the owner obtained paid independent legal advice (s 36). On withdrawal the contractor may keep the retainable amount (reasonable out-of-pocket expenses plus $100 for a s 35(1) withdrawal), must refund the balance of any prepaid amount, and the owner is otherwise not liable. For a repair contract the owner may waive the right by written notice (s 39).
