Queensland Building and Construction Commission Act 1991
Schedule 1B: Domestic building contracts – Queensland Building and Construction Commission Act 1991

Queensland Building and Construction Commission Act 1991 sch1b-32-43: Sch 1B ss 32 and 43 No arbitration clauses and no caveats over a resident owner's land

A term of a regulated contract or other agreement requiring disputes under the contract to go to arbitration is void (except an agreement made after the dispute arises), and the Commercial Arbitration Act 2013 does not apply otherwise (s 45). A domestic building contract gives the contractor no caveatable interest in a resident owner's land, and lodging a caveat over land of an owner known to be a resident owner is an offence (100 penalty units).
