Queensland Building and Construction Commission Act 1991 sch1b-31: Sch 1B s 31 Obtain foundations data before contracting for footings or slab work

Where the proposed work requires building or altering footings or a slab, or may adversely affect them, the contractor must obtain appropriate foundations data for the site before entering the contract, having regard to the Building Code of Australia, the need for a drainage plan, engineer's drawings and computations, and the fall of the land, unless it cannot lawfully enter the land and the contract guarantees no price increase from the data (100 penalty units). Existing reasonable data may be relied on. It must give the owner a copy of the data on payment of its cost (10 penalty units). A contractor that contracted without the data cannot claim extra amounts that the data would have revealed.
