Where a licensee is selected under an approved audit program, or the Commission has reasonable grounds for concern that it does not meet the minimum financial requirements or has not complied with Part 4A, Part 5, Schedule 1B or chapter 8 of the Building Act 1975, the Commission may by written notice require copies of, or access to, the financial records or documents it reasonably needs. The licensee must comply within 21 days of receiving the notice unless it has a reasonable excuse (self-incrimination is not one). Maximum penalty 100 penalty units; non-compliance is also taken to be a breach of a licence condition for suspension or cancellation.
