OSHA Safety and Health Regulations for Construction (29 CFR Part 1926) 1926.1442: 1926.1442 Railroad roadway maintenance machines

Employers using covered equipment that meets the 49 CFR 214.7 definition of a roadway maintenance machine must comply with Subpart CC, except for listed provisions when they are subject to Federal Railroad Administration authority. Excepted are: operator certification, training and evaluation in 1926.1427 and the training section 1926.1430, and the qualification and training provisions in 1926.1436(q), 1926.1440(a) and 1926.1441(a); rail clamps and rail stops under 1926.1415(a)(6); the swing radius work-area controls in 1926.1424(a)(2); out-of-level work restrictions and crane level indicator requirements and their inspection (1926.1415(a)(1), 1926.1402(b) and 1926.1412(d)(1)(xi)); the prohibition on dragging loads sideways in 1926.1417(q); and the boom hoist limiting device in 1926.1416(d)(1) where the booms are raised by hydraulic cylinders. Where the employer is subject to 49 CFR part 214, the duties to follow manufacturer guidance in 1926.1434 and in 1926.1417(a), (r), (u) and (aa), 1926.1404(j), (m) and (q), 1926.1415(a)(6), 1926.1433(d)(1)(i) and 1926.1441 also do not apply. All other Subpart CC requirements continue to apply to these machines.
