OSHA Safety and Health Regulations for Construction (29 CFR Part 1926) 1926.1400: 1926.1400 Scope

Sets the reach of Subpart CC: power-operated equipment used in construction that is able to hoist, lower and move a suspended load horizontally. Covered types include articulating (knuckle-boom), crawler, floating and barge-mounted, locomotive and mobile cranes (wheel-mounted, rough-terrain and all-terrain units, boom trucks and cranes mounted on commercial trucks), multi-purpose machines set up to hoist with a winch or hook, carry-deck and other industrial cranes, dedicated pile drivers, service or mechanic trucks with a hoist, monorail cranes, tower cranes (hammerhead, luffing and self-erecting), pedestal, portal, overhead and gantry, straddle and sideboom cranes, and derricks, plus variations. Coverage extends to the equipment when fitted with attachments such as hooks, magnets, grapples, clamshell, orange peel and concrete buckets, draglines, personnel platforms, augers, drills and pile driving gear. Paragraph (c) lists 18 exclusions, among them machinery converted to a non-lifting use; excavators, backhoes, wheel and track loaders (even when rigged to lift); wreckers and tow trucks clearing wrecks; digger derricks doing pole and utility work under Subpart V or 1910.268 (only if that subpart or section is fully met); aerial devices and self-propelled elevating work platforms; telescopic gantry systems; stacker cranes; forklifts unless set up with a winch or hook; mechanic trucks used for equipment repair; come-a-longs and chainfalls; dedicated drilling rigs; gin poles erecting communication towers; tree work; A-frame anchor handling and dredging; roustabouts; helicopter cranes; flash-butt welding trucks; and knuckle-boom truck cranes delivering material to the ground or placing sheet goods and packaged supplies with a fork or cradle when an automatic overload prevention device works. That delivery exclusion is lost when the crane holds material for attachment, handles prefabricated components such as trusses and wall panels, or handles structural steel. Every section applies unless it says otherwise. Controlling entity duties include 1926.1402(c) and (e) and 1926.1424(b). Wherever the subpart tells an operator, crew member or other employee to act, the employer must set work rules, communicate them effectively and enforce them. For Subpart V work, meeting 1926.959 counts as meeting 1926.1407 to 1926.1411, and the ground conditions section does not apply to rail cranes on FRA-regulated general system track that meet FRA rules.
