OSHA Safety and Health Regulations for Construction (29 CFR Part 1926) 1926.1434: 1926.1434 Equipment modifications

Modifications or additions affecting capacity or safe operation are banned unless one of five routes is satisfied. (1) The manufacturer approves in writing, load charts, procedures, manuals and plates, tags and decals are updated to match, and the original safety factor is not reduced. (2) The manufacturer, given a detailed description and asked to approve, declines to review the technical merits or does not acknowledge the request or begin reviewing it within 30 days; then a registered professional engineer qualified with respect to that equipment must approve the change, state which configurations the approval covers and update charts, procedures, manuals and decals, with the original safety factor preserved. (3) The manufacturer is unavailable and the same engineer conditions are met. (4) The manufacturer agrees to review but does not finish within 120 days of receiving the detailed description, and the engineer conditions are met. (5) Marine worksite equipment whose major structural components come from two or more manufacturers, with the engineer conditions met. A modification is prohibited where the manufacturer reviews its technical safety merits and rejects it with written reasons. A rejection without written reasons may be treated as a refusal to review under route (2). Changes that the U.S. military makes or approves are outside these rules.
