NSW Residential Tenancies Act 2010
Part 5: Termination by the landlord – NSW Residential Tenancies Act 2010

NSW Residential Tenancies Act 2010 s87F: s 87F Significant renovations or repairs needing vacancy: 90/60 days, works within 2 months, 4-week bar, not while a repair order applies

The landlord may give notice where significant renovations or repairs need the premises vacant and are planned to start within 2 months after the termination date, with the 90-day (periodic and longer fixed terms) or 60-day (fixed terms of 6 months or less) periods and fixed terms ending no earlier than the term. It may not use this ground while a Tribunal repair order under s 65(2) or a landlord rectification order applies, and does not re-let within 4 weeks after the termination date without the Secretary's approval.
