Part 5: Termination by the landlord – NSW Residential Tenancies Act 2010

NSW Residential Tenancies Act 2010 s87E: s 87E Proposed sale with vacant possession: 90 days (60 for fixed terms of 6 months or less), 6-month re-letting bar

Where the premises will be offered for sale with vacant possession, the landlord gives at least 90 days' notice for a periodic agreement, and for a fixed term a date on or after its end and at least 60 days (terms of 6 months or less) or 90 days (longer terms) after the notice; it does not re-let within 6 months after the termination date without the Secretary's approval (given where reasonable efforts to sell failed or life circumstances changed exceptionally), a bar that lifts once the premises are sold.
