NSW Home Building Act 1989 s99: ss 99 and 100 Insurance contracts must cover the prescribed risks

An insurer's contract of insurance required by s 92 must insure the person for whom the work is done against loss from non-completion because of the contractor's insolvency, death or disappearance, and that person and successors in title against being unable, for those reasons, to have the contractor rectify a breach of statutory warranty or to recover compensation for it (developers and prescribed classes need not be insured). Cover extends to non-contracting owners. Insolvency of any partner is insolvency of a partnership contractor, and the policy must say so. The cover may be split into a construction period contract (non-completion and warranty loss on non-completion) and a warranty period contract, with the same or different licensed insurers. Insurance required by s 96 for work not under contract must cover the purchaser and successors against being unable to have warranty breaches rectified or compensated because of the contractor's insolvency, death or disappearance, with the same partnership term.
