NSW Home Building Act 1989 s101: s 101 Policies deem a s 42A licence suspension to be insolvency

A home building compensation contract of insurance must deem the automatic suspension of the contractor's licence under s 42A (for an unpaid building claim order) to be the contractor's insolvency, for loss that is the subject of an unsatisfied building claim order. Such a claim is limited to loss that insolvency cover would meet, is not capped by the order, does not limit the beneficiary's appeal rights or the insurer's recovery against the contractor, and applies where the licence would have been suspended but had expired, been surrendered or been cancelled.
