NSW Home Building Act 1989 s92: s 92 Insure contract work and give the certificate before starting work or taking money

For residential building work under a contract above the prescribed contract price (stages between the same parties are added together), a person must not do the work, and must not demand or receive any payment under the contract (deposit or otherwise, before or after work starts), unless a contract of insurance complying with the Act is in force for that work in the name under which the person contracted, and a certificate of insurance in the Authority-approved form has been given to the other party (or one of them). The insurance extends to rectification work on the original work. An alternative indemnity product under Part 6B may be used instead. Maximum penalty 1,000 penalty units for a corporation and 200 otherwise, with 500 penalty units or 12 months' imprisonment for a repeat individual offence.
