A contract to sell a house or unit that falls outside the definition of dwelling because it was built or adapted for commercial tourist, holiday or overnight letting must prominently state that the Home Building Act 1989 does not protect the property, where work was done in the previous 6 years that would otherwise have been residential building work. A vendor must not enter the contract without it; the contract is voidable by the purchaser before completion. Maximum penalty 1,000 penalty units for a corporation and 200 otherwise.
