Queensland Building and Construction Commission Act 1991 s68B-68C: ss 68B and 68C Collect and pay the home warranty premium before work starts or within 10 business days

A licensed contractor who is to carry out residential construction work under a contract with a consumer (not under a construction management contract) must collect the appropriate insurance premium from the consumer and pay it to the Commission before the earlier of 10 business days after the contract was entered into and the start of work; for speculative residential construction work it must pay the premium before work starts. A licensed construction manager engaged by a principal to manage residential construction work must collect the premium from the principal and pay it before the earlier of 10 business days after engagement and the start of work (the amount paid to the construction manager is added to the insurable value). The contractor pays on the consumer's behalf and gains no cover itself. Maximum penalty 100 penalty units.
