Japan Act on Specified Commercial Transactions (Act No. 57 of 1976) Art.12-3: Art. 12-3, 12-4 Opt-in email advertising, opt-out and records

The seller must not send mail-order email advertisements (including SMS) without the recipient's consent or request, except when attached to order, contract or performance notices or in the ordinance cases (advertising within emails the recipient requested or consented to, or free email services carrying advertisements); must stop on an opt-out unless the recipient later re-consents; must keep records of the consent or request (for three years from the last advertisement, Regulation Article 30); and must show in each advertisement, besides the Article 11 items, an easily recognisable email address or URL for opting out (Regulation Article 31). If all these tasks are outsourced in one package, the contractor carries the duties (Article 12-4). Obtaining consent through a screen where the customer cannot easily tell they are opting in is conduct grounding instructions (Regulation Article 42(2)).
