Where it processes personal data for its statutory tasks, the employer is the controller under data protection law, and employer and council support each other in compliance. The data protection officer keeps confidential toward the employer any information that allows conclusions about the council's internal deliberations, and the confidentiality and testimony rules of BDSG ss 6(5) sentence 2 and 38(2) apply between officer and employer.
