Title II: Registration of substances – EU REACH Regulation (Regulation (EC) No 1907/2006)

EU REACH Regulation (Regulation (EC) No 1907/2006) 8: Only representatives of non-Union manufacturers: hold the know-how, data and customer records the role requires

What does 8 require?

A non-Union manufacturer, formulator or article producer may agree with a person or company established in the Union that it will act as its only representative to fulfil the importer obligations of Title II. The representative must also meet all other importer obligations, have sufficient background in the practical handling of substances and their information, and keep available and up to date the quantities imported, the customers sold to and the supply of the latest safety data sheet update. The non-Union manufacturer must tell the importers in the same supply chain of the appointment; those importers then count as downstream users.
