ESRS (revised 2026) S1-16: Incidents of discrimination and other human rights incidents

What does S1-16 require?

For material sub-topics and subject to privacy law the undertaking discloses how many substantiated discrimination incidents at work were identified in the period, on grounds such as gender, race or ethnicity, nationality, religion or belief, disability, age or sexual orientation and including harassment; how many substantiated human rights incidents other than discrimination were connected to its own workforce; and the fines, penalties and damages booked in the accounts for such incidents (connected to the accounts under ESRS 1 Chapter 9). Incidents count when substantiated by objective, factual and verifiable information and verified by a court, the OECD or an administrative authority, covering judicial and non-judicial proceedings and incidents identified internally, with the compilation methodology disclosed and cross-references to the grievance and action disclosures where useful.
