At closure of a tank system all waste residues, contaminated containment components, soils, structures and equipment must be removed or decontaminated and managed as hazardous waste (unless 261.3(d) applies), with closure plans, cost estimates and financial assurance under Subparts G and H. If contaminated soils cannot practicably be removed or decontaminated, the tank system must close and receive post-closure care as a landfill under 264.310 and be treated as a landfill for Subparts G and H. A tank system without compliant secondary containment or a variance must have a closure plan plus a contingent landfill closure plan and a contingent post-closure plan submitted with the permit application, with cost estimates and financial assurance based on the higher contingent costs.
