EPA RCRA Hazardous Waste Management 264.119: § 264.119 Post-closure notices

Within 60 days after certifying closure of each disposal unit the owner or operator must submit to the local zoning or land use authority and the Regional Administrator a record of the type, location and quantity of hazardous wastes disposed of in each cell or unit (to the best of its knowledge for waste disposed before January 12, 1981). Within 60 days of certifying closure of the first and of the last disposal unit it must record, under state law, a notation on the property deed or another instrument examined in title searches that permanently notifies any purchaser that the land was used to manage hazardous waste, that its use is restricted under Part 264 Subpart G, and that the survey plat and waste record have been filed, and must certify to the Regional Administrator that it did so, with a copy. Anyone later wishing to remove wastes, residues, liners or contaminated soils must obtain a post-closure permit modification showing the removal meets 264.117(c), becomes a generator of the removed waste, and may then request removal of the deed notation or add a notation recording the removal.
