The owner or operator must have a written closure plan (and contingent closure plans where 264.228 or 264.258 require), submitted with the Part B application under 270.14(b)(13) and approved as a permit condition, furnished on request until closure is certified. It must identify the steps for partial and final closure at any point in the active life and include: how each unit will be closed; how final closure will be done, identifying the maximum extent of operations unclosed during the active life; an estimate of the maximum inventory of hazardous waste ever on site and the methods for removing, transporting, treating, storing or disposing of it, with the off-site unit types; the steps to remove or decontaminate residues, containment components, equipment, structures and soils, with cleaning procedures, soil sampling methods and decontamination criteria; other closure-period activities such as ground-water monitoring, leachate collection and run-on and run-off control; a schedule for each unit and final closure with total times and intervening activities; the expected year of closure where trust funds are used and closure precedes permit expiry; and any alternative requirements applied to a regulated unit. Amendments go by permit modification request with the amended plan: at any time before closure notification, and mandatorily when operating plans or design changes affect the plan, the expected closure year changes, unexpected events during closure require it, or alternative requirements are requested; the request is due at least 60 days before the change, within 60 days after an unexpected event, or within 30 days of one during closure, and plans requested by the Regional Administrator within 60 days (30 during closure). The Regional Administrator must be notified in writing at least 60 days before closure of a surface impoundment, waste pile, land treatment or landfill unit (or final closure of a facility with one), and at least 45 days before final closure of a facility with only tanks, container storage or incinerators or before closure of a boiler or industrial furnace; closure is expected to begin within 30 days after a unit receives its known final volume, or within one year of the most recent volume where more may come, unless an extension is justified.
