Within 90 days after receiving the final volume of hazardous waste at a unit or facility, the owner or operator must treat, remove or dispose of on site all hazardous waste per the approved closure plan, and must complete partial and final closure within 180 days, unless the Regional Administrator approves longer periods through a permit modification, on a demonstration (made at least 30 days before the 90-day or 180-day period expires) that the work will necessarily take longer, or that the unit can take more waste, operation is reasonably likely to resume within one year and closure is incompatible with continued operation, together with all steps being taken to prevent threats. The Regional Administrator may allow a landfill, land treatment unit or surface impoundment to receive only non-hazardous waste after the final hazardous receipt, on a permit modification request filed no later than 120 days before the final hazardous receipt showing design capacity, likelihood of non-hazardous receipts within one year, compatibility, incompatibility of closure with operation and continued compliance, and including an amended waste analysis plan, ground-water program, human exposure assessment, closure and post-closure plans and updated cost estimates and financial assurance. A surface impoundment not meeting the statutory liner and leachate requirements must also submit a contingent corrective measures plan and a waste removal plan, remove all hazardous liquids and, as far as practicable, sludges within 90 days of the final hazardous receipt, implement corrective measures within one year of detecting a release, report annually on corrective action progress, and may be ordered to begin closure after public notice if it fails to implement or progress.
