Part 746: Embargoes and other special controls – EAR - Export Administration Regulations

EAR - Export Administration Regulations 746.2: 746.2 Cuba

A licence is required to export or reexport all items subject to the EAR to Cuba, including release of CCL technology or source code to Cuban nationals, except under the listed exceptions (TMP news media, TSU operation, sales and update provisions, RPL, BAG, GOV, GFT, TMP in transit from Canada, AVS, APR spare parts, AGR, CCD and SCP); EAR99 technology releases to Cuban nationals need no licence. Applications face a general policy of denial, with approval generally for medicines and medical devices (subject to verification and misuse limits), telecommunications, civil society, news bureaus, certain agricultural items, civil aviation safety and environmental protection, case-by-case review for items meeting the needs of the Cuban people (with conditions against reexport and state revenue uses), and denial for state revenue-generating enterprises, military, police, intelligence and security services and entities on the State Department's Cuba Restricted List; OFAC controls on U.S. persons (31 CFR part 515) also apply.
