Chapter 3 Part 3-1: Unfair practices – Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2)

Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2) s48: s 48 State a prominent single total price when quoting part of the price of household goods or services

When a business represents an amount that is part of the price for goods or services of a kind ordinarily acquired for personal, domestic or household use, it must also state, prominently and as a single figure, the single price: the minimum quantifiable total consideration at that time, including non-optional charges (and optional charges pre-selected by the business unless the customer has deselected them), taxes such as GST, and amounts paid on the customer's behalf under government arrangements. The single price must be at least as prominent as the most prominent part-price (except for periodic-payment service contracts). Delivery charges may be left out, but a known minimum delivery charge must then be stated. Representations made only to bodies corporate are excluded. Reg 80A exempts restaurant, cafe and similar menu surcharges for specified days if the menu states 'a surcharge of [percentage] applies on [day or days]' transparently and at least as prominently as the most prominent price or fee.
