A casual must work, on average across any 2 consecutive weeks, fewer than 38 ordinary hours or fewer than 5 days a week. On top of the weekly hire hourly minimum for the work, the employer must pay a casual 25% of that hourly minimum, and each engagement attracts payment for at least 3 hours. The loading replaces entitlements casuals do not receive under the award and the NES. Overtime by a casual is paid at the casual rates in clause 22.1(a). The pathway from casual to full-time or part-time work is set by the NES (ss 66A to 66MA of the Act), with disputes under ss 66M and 66MA or clause 32.
