Under WHS Regulation 295 a designer must give the PCBU that commissioned the design a written report specifying the hazards, so far as the designer is reasonably aware, that create a health and safety risk to those carrying out the construction work and are associated only with the particular design and not other designs of the same type. It applies to unusual or atypical design features and should include any hazardous materials or structural features, the designer's assessment of the risk to construction workers and the action taken to control it, such as design changes. The client must give the principal contractor a copy of all the information in the report about hazards or risks at or near the workplace.
