Australia Model Code of Practice: Safe Design of Structures 1.2a: 1.2 PCBUs and designers owe the primary and designer duties for structures

A PCBU must ensure so far as reasonably practicable that workers and others are not exposed to risks from the business (WHS Act s 19). A PCBU that designs a structure that will be used, or could reasonably be expected to be used, as a workplace must ensure so far as reasonably practicable that it is designed to be without risks to the health and safety of people using it for its designed purpose, constructing it, carrying out reasonably foreseeable activities connected with manufacture, assembly, use, proper demolition or disposal, and people in the vicinity exposed to the structure (s 22). The duty includes carrying out or arranging testing and analysis and providing specific information to certain persons.
