Australia Model Code of Practice: How to Manage Work Health and Safety Risks 1.1a: 1.1 The PCBU must eliminate risks, or minimise them so far as reasonably practicable

A PCBU owes the primary duty of care (WHS Act s 19): eliminate risks to health and safety, or where that is not reasonably practicable minimise them so far as is reasonably practicable. The duty applies when the PCBU engages or directs workers, when work in its business could put others at risk, and when it manages or controls a workplace or the fixtures, fittings and plant there. The Regulations add specific requirements for psychosocial hazards, hazardous chemicals, airborne contaminants and plant. PCBUs also owe duties to consult workers and to consult, cooperate and coordinate with other duty holders.
