Item 3 omits "in principle" from subsection 11(1). The subsection contains the central approval test. It requires the Minister, in the absence of exceptional circumstances, to be satisfied with a high level of confidence that the pathology services to be rendered at the premises will meet the relevant standards for the kinds of services and the category, and that the premises comply with the Act and the Principles. With the amendment, the test applies to the approval and not to a preliminary approval. The two limbs, the standards and the statutory compliance, remain.
